These conditions of sale are concluded on the one hand by the site Bedouine.fr headquartered what is at BP 80118 13363 Marseille Cedex 10, registered with the Companies and Establishments Directory (SIREN) under SIREN number 801 229 485 and SIRET 801 229 485 00017 hereafter Bedouine, and secondly, any person or entity wishing to make a purchase on the website bedouine.fr, hereinafter “buyer”.The products covered by these Terms and Conditions are those listed on the Website www.bedouine.fr and are listed as sold and shipped by Bedouine. They are offered subject to availability.
Products are described and presented with the greatest possible accuracy. However, if errors or omissions have occurred in this presentation, the responsibility Bedouine could not be committed.
Photographs of products are not contractual.
ARTICLE 3: Prices
Product prices are indicated in euros all taxes included. They take into account any reductions applicable on the date of the order. Product prices are exclusive of delivery charges (freight and packaging making the package according to the amounts in force). The amount of shipping will be specified on the order form before validating the order.
If one or more taxes or contributions, including environmental, were to be created or modified, up as down, this change will be reflected in the selling price of the products present on the Website and the various sales materials.
However, a price can not be changed once the order of User validated.
ARTICLE 4: ORDER
4.1. Prior User Identification
To place an order, the buyer must identify with their email address or customer number and password. To first order, the buyer will have to follow an account creation instructions on the website www.bedouine.fr
If lost or forgotten password, the buyer may ask again by going to his account and clicking on “Forgot Password”. He will receive his password to the email address he provided at time of registration.
4.2. Registration and confirmation of the order
Once the basket validated the buyer must accept the terms and conditions, select the address and mode of delivery, and finally validate the method of payment, this last step formalizing the contract of sale between the buyer and Bedouine.
Any order implies acceptance of prices and descriptions of products available for sale.
Bedouin acknowledge receipt of the order upon validation by sending an e-mail.
In some cases, particularly non-payment, incorrect address or other problem on the account of the buyer, Bedouine reserves the right to block the order from the buyer until the problem. In case of unavailability of the product ordered the buyer will be informed by email.
The cancellation of the order of this product and its eventual repayment (only products available at time of order may be a levy, as opposed to deferred revenue) will then be carried out, the rest of the order remaining firm and final.
ARTICLE 5: PAYMENT METHOD
The buyer has the option to pay for purchases:
– By credit card via PAYPLUG: Carte Bleue, e-carte bleue, Visa, Mastercard, American Express.
– With a PayPal account: choosing the PAYPAL payment, the buyer will be automatically directed to the PayPal account. Once the payment is confirmed, the buyer may terminate the order on the website.
Bedouin does not keep track, and has no access to bank customer data.
ARTICLE 6: DELIVERY
6.1. Method of Delivery
Products will be delivered to the address specified by the buyer. All products leave our premises in perfect condition; and the customer must notify the carrier the slightest trace of impact (Holes, traces of crushing …) on the parcel, and if appropriate to refuse the package. A new product will be sent to him at no cost.
The exchange of any product declared, a posteriori damaged during transport, without any reservation has been issued on receipt of the package may not be supported by Bedouine.
As in all expeditions, it is possible to be delayed or that the product gets lost. In such cases, we contact the carrier to start an investigation. Every effort is made, as long as necessary, to find this package. Where appropriate the merchant will be reimbursed by the carrier and deliver a new package identical to its costs. We disclaim all or part of our responsibility if we can prove that the non-performance or improper performance of the supply contract is attributable to the consumer or to the unforeseeable and irresistible, a third contract, or to a force majeure (according to paragraph 5 of Article L.121-20-3 of the consumer code).
6.2. Delivery error
The consumer must make to Bedouine within 7 days, any claim of error of delivery and / or non-conformity of goods in kind or in quality compared to entries on the site. The formulation of this claim with Bedouine may be made by mail or email. Any claim not made in the rules defined above and on time will not be taken into account and release Bedouine any vis-à-vis the buyer’s responsibility.
In case of error of delivery or exchange any product for exchange must be returned to Bedouine a whole, in good condition and labeled.
ARTICLE 7: WITHDRAWAL RIGHTS
The right of withdrawal applies only to natural persons.
In accordance with Articles L.121-20, the consumer has a period of 15 calendar days to return, at its expense, the products do not suit him. This period starts from the day of receipt of the consumer’s order. All returns will be reported prior to the Customer Service Bedouine. The product should be returned to BP 80118 13363 Marseille Cedex 10 labeled, intact and not worn.
Any product that has been damaged after receipt thereof will not be refunded, returned or exchanged.
This right of withdrawal is without penalty, except for return shipping costs (Article L21-20). Assuming the exercise of the right of withdrawal, the consumer the option of requesting either a credit or exchange products. In the case of an exchange the return will be at the expense of consumers.
ARTICLE 8: RESPONSIBILITY
Bedouin in for all order taking steps and for the steps after the contract is an obligation of result.

However, its liability will be incurred if the breach of its obligations would be due to an unforeseeable and irresistible a third contract is a case of force majeure as defined by French jurisprudence. ARTICLE 9: INTELLECTUAL PROPERTY

Similarly, trademarks, logos, drawings, and models on the site are the exclusive property of Bedouine. Their disclosure shall in no way be construed as granting any license or right to use any of the trademarks and distinguishing elements protected by copyright. They can therefore be used, subject to prosecution.
And no material from the site may be copied, reproduced, republished, uploaded, posted, transmitted or distributed in any way whatsoever.
However, it is possible to download a copy of the documents on a computer for personal use of the user and only for non-commercial purposes, provided that the user does by changing the information and it keeps intact all copyright and other proprietary notices. The modification of these documents or use for another purpose constitutes an infringement of intellectual property rights.
ARTICLE 10: NO VALIDATION PARTIAL
If any provision of these terms are held to be validated or declared such pursuant to a law, regulation or following a final decision of a competent Court, the other provisions remain in full force and scope.
ARTICLE 11: NO WAIVER
The failure of either party not to claim a breach by the other party to any of the obligations set under these Conditions of Sale shall not be interpreted for the future as a claim the obligation in question.
ARTICLE 12: PROTECTION OF PERSONAL DATA
All data that the user entrusts Bedouine, are able to process their orders.
Under Law No. 78-17 of 6 January 1978 on computers, files and liberties, the User has a right of correction, consultation, modification and deletion of the data.
ARTICLE 13: APPLICABLE LAW AND JURISDICTION
Any order placed through www.bedouine.fr won the support of the customer, without any restriction, the General Conditions of Sale Bedouine. In case of dispute, the User may enter the District Court or Grande Instance with territorial jurisdiction of its choice in accordance with Article 46 of the Book 1 Chapter 2 of the Code of Civil Procedure. This Article provides in principle that the applicant who files a court action may apply either the court where the defendant lives or where the court has been delivered the goods.
If sold to a corporation, any disputes concerning the sale (price, CGV, product ….) Will be subject to French law before the Tribunal of Commerce headquarters Bedouin.
